Privacy Policy

This policy explains what information Markout ("we") collects when you use getmarkout.comand our services, how we use it, and the choices you have. We do not sell personal information.

• Account information: your name, email address and login details, handled by our authentication provider (Clerk), including when you sign in with Google.
• Business information: what you enter during setup and later, such as business name, address, phone, website, trade, service area and logo, and details we look up from public sources such as your Google listing.
• Google Business Profile data: if you connect your profile, we access your business locations, reviews, questions and answers, and posts so we can display them, draft replies and publish the replies and posts you approve.
• Content you create: AI-generated drafts, landing pages, posts and replies, and the instructions you give.
• Your customers' information: if you send review requests or messages, the names, email addresses or phone numbers you provide. You remain responsible for having permission to contact them.
• Free audit requests: the business and contact details submitted through our free audit form.
• Payment information: handled by Stripe. We receive your plan, billing status and the last digits of your card, but never your full card number.
• Usage information: pages viewed, features used, device and browser details, IP address and cookies needed to keep you signed in and to understand how the product is used (via PostHog).

• to provide the Service, including generating content, running visibility and ranking checks, and syncing and publishing to connected accounts;
• to process payments and manage your subscription;
• to send account and service emails, such as your welcome email, reports and billing notices;
• to respond to support requests and free audit requests;
• to secure the Service, prevent abuse and fix problems;
• to understand usage and improve the product;
• to comply with legal obligations.

Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We use Google Business Profile data only to provide the features you use in Markout. We do not sell it, use it for advertising, or use it to train generalized AI models. We share it only with the service providers listed below as needed to run those features, and people at Markout access it only with your permission, for security, or as the law requires. You can disconnect Google at any time, and revoke access from your Google Account settings.

To generate content and check how AI assistants answer questions about local businesses, we send the necessary business details and prompts to AI providers: Anthropic (Claude), OpenAI (ChatGPT), Google (Gemini), Groq and Perplexity. We send only what a feature needs. Visibility checks ask general questions about your trade and area rather than sending your customers' personal information.

We share information only with providers that help us run the Service, under their own privacy and security commitments:

• Clerk (sign-in and accounts)
• Stripe (payments)
• Google (Business Profile, Maps and Places, Search Console)
• Anthropic, OpenAI, Google Gemini, Groq and Perplexity (AI generation and visibility checks)
• Resend (email delivery)
• Railway, Neon and Upstash (hosting, database and job queue)
• PostHog (product analytics)

We may also disclose information if required by law, to protect rights and safety, or as part of a merger, acquisition or sale of assets, in which case this policy will continue to apply to it.

We keep your information while your account is active and as needed to provide the Service. You can ask us to delete your account and data at any time by emailing hello@getmarkout.com; we will do so within 30 days, except for records we must keep for legal, tax or security reasons.

We use reasonable safeguards including encryption in transit, access controls and reputable infrastructure providers. No system is completely secure, so we cannot guarantee absolute security.

You can view and update your business information in the app, disconnect connected accounts, and cancel your subscription at any time. Depending on where you live, including under the Texas Data Privacy and Security Act, you may have the right to access, correct, delete or obtain a copy of your personal information, and to opt out of certain processing. To make a request, email hello@getmarkout.com. We will not discriminate against you for exercising these rights.

The Service is for businesses and is not directed to children under 13. We do not knowingly collect their information.

We may update this policy. If a change is material we will notify you by email or in the Service before it takes effect. The effective date above shows when it last changed.
